Heavy vehicle driver fatigue legislation

The National Heavy Vehicle Work and Rest Hours Exemption (Personal Use) Notice (No.1) provides up to an hour of additional work time to drivers under Standard Hours to use a fatigue-regulated heavy vehicle for permitted personal activities. The Heavy Vehicle (Fatigue Management) National Regulation sets work limits and rest limits for heavy vehicle drivers and requires better management of driver fatigue. Unless your journey is within a radius of kilometres from the place of business from which your vehicle normally operates, you must record your work/rest details in a National Driver Work Diary. The HVNL consists of the Heavy Vehicle National Law * and five sets of regulations. The HVNL commenced on 10 February in the Australian Capital Territory, New South Wales, Queensland, South Australia, Tasmania and Victoria. Each of them passed a law that either adopts or duplicates the HVNL (with some modifications) as a law of that State.

National Transport Commission (Model Legislation - Heavy Vehicle Driver Fatigue) Regulations These Regulations provide model legislation regulating heavy vehicle driver fatigue for nationally consistent implementation in each State and Territory. In addition to the general duty to not drive a fatigue-regulated heavy vehicle on a road while fatigued, drivers must comply with certain maximum work and minimum rest limits. Parties in the supply chain have to take all reasonable steps to prevent the drivers from exceeding these limits. This is similar to occupational health and safety laws and means that drivers must be allowed to stop if they are at risk of exceeding the limits and make alternative arrangements. This Regulation may be cited as the Heavy Vehicle (Fatigue Management) National Regulation. 2 Commencement This Regulation commences in a participating jurisdiction on the day on which Chapter 6 of the Law commences in that jurisdiction.
